It is seen from the note put up by the Registry that notice to R6 is served and name is printed in the cause list. Notice to R5 is returned unserved. 2.These applications have been filed for condonation of delay in filing the application to set aside the abatement on the death of the second plaintiff and implead the legal heirs of the second plaintiff namely K.Priya as 6th plaintiff and K.Rekha as 9th defendant. Proposed 9th defendant K.Rekha was already set ex-parte.
3.The contesting respondents have no objection for allowing these applications.
4.Considering the reasons stated in the affidavit filed in support of the delay condonation application to set aside the abatement and impleading the legal heirs of the second plaintiff, being satisfied with the reasons, this Court allows all the three applications.
