The petitioner seeks for a mandamus to forbear the respondents from shifting the TASMAC Shop No.3409 from the present location at D.No.4, Veterinary Hospital Street, Ammapet, Anthiyur Taluk, to any other place and permit the petitioner to participate in the public auction to run the bar and sell eatables at Shop No.3409 in the said location.
2. After notice, this matter is listed today before this Court for further hearing. Learned Standing Counsel for the 2nd and 4th respondents submitted that the subject matter Shop has already been shifted to other place at Ammapet, Padavalkalvai Post, Andiyur Road, Andiyur Taluk, on 25.07.2018. He has also produced a communication addressed by the 4th respondent to the learned Standing Counsel for the 2nd and 4th respondents before this Court informing the above shifting of the Shop.
3. Learned counsel for the petitioner submits that the above facts may be recorded and the writ petition may be closed.
4. Considering the above stated facts and circumstances, more particularly, the fact that the subject matter Shop has already been shifted, this Writ Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
