This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 12.06.2024, seeking bail in Crime No.313 of 2024 registered for the offence under Sections 341, 294(b), 323, 397, 336 & 506(ii) of IPC.

2. Learned counsel appearing for the petitioner submitted that this is the second application for bail filed by the the petitioner before this Court. He further submitted that the petitioner is no way connected with the alleged offence and he has been falsely implicated in this case. Further, the petitioner is suffering from chronic haemorrhoids and he has been taken treatment for the same, hence, he sought for bail.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that, the petitioner/A2, who is a habitual offender having 13 previous cases, along with A1 waylaid the de facto complainant, abused him in filthy language, robbed a sum of Rs.620/- from him at knife point, threatened him with dire consequences. He further submitted that the earlier bail application filed by the petitioner was dismissed only on 05.07.2024 and there is no change in circumstances. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) that the investigation is still pending in this case and there is no change in circumstances and also considering the conduct of the petitioner, this Court is not inclined to grant bail to the petitioner.
