Defendants Civil suit praying that this Hon'ble Court be pleased to pass a Judgment and Decree against the Defendant No.1 and Defendant No.2 jointly and severally directing them to: a) Pay a sum of Rs.1,56,41,200/- towards the outstanding dues as on the date of filing of the suit to the plaintiff No.1;
b) award interest @ 24% per annum on the outstanding amount of Rs.1,56,41,200/- from 29.12.2010 till 14.12.2012
which comes to Rs.77,09,260/- in favour of Plaintiff No.1; c) award pendente lite and future interest @ 24% per annum on the outstanding amount in favour of plaintiff No.1; d) to pay costs of the suit to the plaintiff No.1; This suit coming on this day before this court for hearing in the presence of Mr.John for M/s. Fox Mandal & Associates, Advocates for the plaintiffs herein and Ms.Sunita Kumari for Mr.L.Rajasekar, Advocates for the Defendants herein and upon reading the plaint and the memo dated 23.08.2018 filed herein, and in the light of the aforesaid memo and reiteration of the same, wherein and whereby the plaintiffs are reporting no instructions, It is ordered as follows:- That the suit in C.S.No. 70 of 2013 be and is hereby dismissed for default/non prosecution.
