This Writ Petition has been filed seeking for issuance of Writ of Mandamus directing the respondent to receive the Application Form CCPA dated 04.07.2018 with prescribed fees and to grant the Maxi Cab Permit in respect of the vehicle bearing Reg.No.TN-02-AP-8057 forthwith.
2.The learned counsel appearing for petitioner has stated that the petitioner has purchased TATA Ace Magic vehicle bearing Reg.No.TN-02-AP-8057, with a seating capacity of 7+1=8 from one M.Jayaraman. The vehicle was covered by All India Tourist Maxi Cab permit, which was valid upto 28.11.2020. The vehicle was registered on 19.11.2010. As per Central Motor Vehicle Rules, 1982, the tourist permit shall be deemed invalid completes nine years in case of motor cab and 8 years where the vehicle is other than motor cab. Before completion of nine years, the petitioner approached the respondent with the Application Form CCPA with prescribed fees on 04.07.2018 for permit. receive the Application Form CCPA with the prescribed fees. Since the respondent refused to receive the Application, the petitioner seeks direction to the respondent to receive the Application Form CCPA dated 04.07.2018 with prescribed fees and for grant of Maxi Cab Permit in respect of the vehicle bearing Reg.No.TN-02-AP-8057.
3.The learned Additional Government Pleader appearing for the respondent has submitted that the respondent will receive the Application Form CCPA with prescribed fees from the petitioner and consider the same within a period of three weeks. 4.Recording the submission made by the learned Special Government Pleader, considering the limited prayer made in the Writ Petition, without going into the merits of the matter, the Writ Petition is disposed of with a direction to the respondent to receive the Application Form CCPA with prescribed fees and consider the same and pass appropriate orders within a period of three weeks from the date of receipt of a copy of this order. No costs.
