ORDER

This Criminal Original Petition has been filed by the petitioner seeking for a direction to the 1st respondent to file the final report before the competent Court pursuant to the registration of Crime No.3/2017 dated 27.06.2017 on its file within a time limit to be stipulated by this Court. The learned counsel for the petitioner would submit that the petitioner had given a complaint to the 1st respondent on 31.08.2015 as against the 2nd respondent herein, stating that the 2nd respondent, by abusing his official power as the Panchayat President, had obtained free patta in the name of his wife and relatives, which patta is meant for the people who are below the poverty line. that subsequent to the receipt of the complaint, the 1st respondent had registered a FIR in Cr.No.3/2017 on 27.06.2017 against the respondents 2 and 3 herein and despite registration of the case on 27.06.2017, the 1st respondent had not filed the Final Report till date and left with no other option, the petitioner had approached this Court by filing the present petition.

The learned counsel for the petitioner would submit that though two years had lapsed since the date of registration of FIR, there is no progress in the investigation and that the 1st respondent has not filed the Final Report in this case and hence, would pray for appropriate orders.

The learned Additional Public Prosecutor appearing for the 1st respondent would submit that the 1st respondent police had completed the investigation and filed the Final Report before the learned Chief Judicial Magistrate, Tiruppur, on 08.05.2019 and cognizance has been taken by the learned Trial Judge and it has been numbered as CC.No.3/2019 and the case has been posted for furnishing of copies to the accused on 22.08.2019.
