(Crime No.699 of 2020) PRAYER: Criminal Original Petition filed under Section 439 of Criminal Procedure Code to enlarge the petitioner/accused on bail in Crime No.699 of 2020 pending investigation before the respondent police station.

ORDER

(The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 16.11.2020 for the offence punishable under Sections 394, 397 of IPC, in Crime No.699 of 2020 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that on 19.06.2020 at about 11.30 P.M, while the defacto complainant was sleeping in his house, 3 unidentified persons came and assaulted the defacto complainant with knife, at that time the defacto complainant had shouted by hearing his sound her Mother and Grand mother had opened the door and came out of their house, at that time one of the accused had snatched the 1 sovereign of Gold Chain from the Defacto complainant's Grand Mother and ran away. Due to some previous enmity existence in between the petitioner and defacto complainant. Hence the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this. Hence, he prays for grant of bail to the https://hcservices.ecourts.gov.in/hcservices/

petitioner. He would further submit that the petitioner was arrested on 19.06.2020.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police would submit that the petitioner given a false complaint. However, he opposed to grant bail to the petitioner.

5. Heard the learned Counsels and perused the F.I.R.

6. Considering the grave nature of the offence and the circumstances of the offence committed, I am declined to grant bail to the petitioner.

7. This Criminal Original Petition shall stand dismissed accordingly.
