ORDER

The petitioner, who apprehends arrest at the hands of the respondent police, for the offences punishable under Sections 303(2) of BNS, 2023 (Section 379 of IPC) in Crime No.171 of 2025, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with other accused committed theft of Motor Cycle. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prayed for granting anticipatory bail to the petitioner.

4.The learned Government Advocate strongly opposed for granting anticipatory bail to the petitioner stating that in this case there are totally 3 2/4

accused, the petitioner is ranked as A3. The co-accused/A1 and A2 were arrested and they are still in jail. He further submitted that the petitioner has got 7 previous cases.

5.It is seen that the petitioner has got 7 previous cases, further the two wheeler is yet to be recovered. In this case, though A1 and A2 were arrested, recovery depends upon the arrest and confession of the petitioner. In view of the same, this Court is not inclined to entertain this anticipatory bail petition and the same is dismissed.
