PRAYER : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondent to complete the investigation in F.I.R. No. 06 of 2018 pending on the file of the respondent and file a final report before the jurisdictional court within a time frame as fixed by this Hon'ble Court.

ORDER

(This case has been heard through video conference) This Criminal Original Petition has been filed seeking to complete the investigation in F.I.R. No. 06 of 2018 pending on the file of the respondent and file a final report.

2. The grievance of the petitioners is that the petitioners are arrayed as A1 and A2. Even though the crime was registered in the year 2018, the investigation is yet to be completed and the final report is to be filed. In the said circumstances, the present petition has been filed.

3. Earlier, this court directed the respondents to file a status report and today, the learned Government Advocate https://hcservices.ecourts.gov.in/hcservices/

appearing for respondent filed a status report stating that entire investigation is over and the investigating authority sought for sanction for prosecution from the competent authority. They have also got a sanction against A1 and the application for sanction of prosecution against A2 is pending with the Principal Secretary to Government, Health and Family Welfare Department, Chennai. As soon as, they got sanction order, they will file a final report.

4. Considering the facts and the circumstances of the case, the investigation is completed and only the matter is pending for sanction for prosecution against A2, the Principal Secretary, Health and Family Welfare Department, Chennai is directed to consider the application and pass suitable orders on merits within a period of four weeks from the date of receipt of copy of this order and thereafter, the investigating authority is directed to file a final report within a period of four weeks. Accordingly, this Criminal Original Petition is disposed of.
