ORDER

The 2nd petitioner herein is the 2nd accused in C.C.No.433 of 2019 pending of the file of the Judicial Magistrate Court, Madukkarai, 2.

The learned counsel appearing for the 2nd petitioner submits that the 2nd petitioner is an innocent college student at the time of occurrence. He has been falsely roped in the case of theft. The stolen article already been recovered and restored to the defacto complainant. While so, for the past 7 years, he is facing the ordeal of criminal prosecution. Hence the case has to be quashed. 3.

The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the trial in this case has almost come to an end. All other witnesses except the police, who has registered the FIR and the Investigating Officer, were examined. The case is posted to 09.08.2024 for examination of LW.9 and LW.10. He further submits that on next hearing, the witnesses will be marshalled and the prosecution side evidence will be closed on completion of examination. 4.

Recording the same, this Criminal Original Petition is 2/4

disposed of directing the Judicial Magistrate to complete the trial within a period of three months from 09.08.2024.
