Crl.M.P.Nos.11241 to 11243 of 2021 in Crl.O.P.Nos.59, 65 & 70 of 2021 V. BHARATHIDASAN, J These petitions have been filed seeking to relax the condition imposed by this Court against the petitioners directing them to report before the CID Q Branch Police Station at Coimbatore on Every Monday and Friday at 10.30 a.m. until further orders.
2. The learned counsel appearing for the petitioners submitted that the petitioners are regularly complying with the conditions for more than six months and out of the three cases, in one case investigation has been completed and final report has been filed and in the other two cases investigation is almost completed. Further the petitioners are not financially sound to stay at Coimbatore.
3. The learned Government Advocate (Crl.Side) appearing for the State submitted that out of the three cases in one case final report has been filed and in other two cases the investigation is yet to be completed and the presence of the petitioners are necessary for completing the investigation and opposed any modification.
4. Considering the facts and circumstances of the case, out of the three cases, in one case investigation is over and final report has been filed and in other two cases investigation is almost completed. The petitioners are complying with the condition for more than six months. Hence, this Court is inclined to relax the condition already imposed by this Court on the petitioners in Crl.M.P.Nos.5249, 5251 and 5252 of 2021 in Crl.O.P.Nos.59, 65 & 70 of 2021 dated 28.04.2021, however the petitioners are directed to appear before the respondent police as and when required.
5. These petitions are ordered accordingly.
