Respondent(s) Prayer: Writ petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents to pay my remaining/balance retirement benefits sum of Rs.8,95,681/- and accrued interest 12% from the date of retirement i.e, 31.08.2024 to till the payment was made by considering my detailed representation dated 07.12.2024 within the stipulated time as fixed by this Hon'ble Court and pass such further or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.

ORDER

Heard Mr.L.P.Shanmugasundaran, learned counsel for the petitioner, Mr.M.Muthusamy, learned Government Advocate and Mr.U.Baranidharan, learned counsel for the 2 nd respondent.

2. The instant writ petition has been filed claiming a sum of Rs.8,95,681/- on account of remaining /balance retirement benefits.

3. However, the 2 nd respondent disputed the petitioner's claim by filing the counter statement. In spite of filing the counter statement, the learned Standing Counsel appearing for the 2 nd respondent as well as the learned Government Advocate appearing for the first respondent would fairly submit that they would consider the representation of the petitioner within a reasonable time.

4. In such view of the matter, without going into the merits of the matter, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 07.12.2024 and pass orders on it's own merits

and in accordance with law, of course in the light of the Full Bench judgment of this Cour in S. Andiyannan v. Joint Registrar, Co-operative Societies, reported in 2015 SCC OnLine Mad 8844, within a period of eight(8) weeks from the date of receipt of a copy of this order On consideration of the above representation in accordance with law, and if the petitioner is eligible for any amount, he is entitled to the statutory interest as provided under the Statutes.
