ORDER
The writ petition has been filed to direct the respondents to consider petitioner's representation dated 28.07.2025 and to consequently include the petitioner's name in the Panel for the post of Director and Professor, Institute of Anaesthesiology for the year 2025.
2. The petitioner joined as Assistant Surgeon, Government Primary Health Centre, Trichy on 15.04.1994. The second respondent vide proceedings dated 28.06.2022 called upon the Dean / Head of Institutions to furnish Willingness/relinquishment from the list of Medical Officers annexed in the said proceedings, in order to prepare panel for the post of Director & Professor, Institute of Anaesthesia for the year 2022 - 2023. The petitioner owing to his family situation was unable to express his willingness, hence he submitted his relinquishment form as per Section 57 of Tamil Nadu Government Servants (Conditions of Service) Act, 2016 on 01.07.2022 and the same came to be accepted by the 1st respondent vide G.O(D).No.1377 dated 28.12.2022. 2.1. Subsequently, the second respondent vide proceedings dated 14.07.2025 called upon the Dean / Head of Institutions to furnish Willingness / Relinquishment from the list of Medical Officers annexed, in order to prepare panel for the post of Director & Professor, Institute of Anaesthesia for the year
2025 - 2026 without including his name in the proceedings. Hence, he gave a representation dated 28.07.2025 to the respondents seeking to include his name in the panel, for which there is no response till date. Therefore, the petitioner is before this Court.
3. Heard the learned counsel on either side and perused the materials available on record.
4. Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the respondents to consider the petitioner's representation dated 28.07.2025, on merits and in accordance with law and to pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order.
