THE HONOURABLE Ms.JUSTICE R.N.MANJULA W.P. No.19100 of 2020 M.Vignesh ...

... Respondent Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to sponsor petitioner name in the priority category of land losers to the Government in the oncoming future employments in the public sector, based on the priority certificates dated 29.09.2004 and 07.05.2019 and further clarification letter dated 19.12.2019 and based on petitioner's representation dated 20.01.2020.
For Petitioner ... Mr.P.Balamurugan For Respondents ... Mr.P.Sanjai Gandhi Govt. Advocate
ORDER
The petitioner who claims himself as the son of one Moorthy filed this Writ Petition seeking Writ of Mandamus directing the respondent to consider himself to be appointed under the land looser's employment scheme.
2. The said Moorthy's land have been acquired for some Government Scheme and as per the rules, he is entitled to get the appointment on priority basis.
3. However the learned Government Advocate submitted that the petitioner is the grandson of the land looser and he is not eligible to get any employment through priority basis. In this regard it is brought to the notice of this Court that the petitioner had filed a writ petition in W.P.No.10608 of 2006 to consider his name under the priority basis. Subsequently he has filed another writ petition in W.P.No.11741 for seeking direction against the second respondent to sponsor his name for employment under land losers scheme and the said writ petition was dismissed on the ground that the
petitioner has crossed the eligible age. Now this petition has been filed seeking that the petitioner is eligible to get the employment under the land losers scheme.
3.1 The learned Government Advocate further submitted that the petitioner is not the son of the land loser but he is the grandson of the land loser and hence no priority can be given for the petitioner in any Government appointment under the Land loosers scheme. However the Tahsildar concerned has given a certificate by stating that the petitioner's father is Moorthy and it has been wrongly mentioned as Rajagopal.
4. Since the jurisdictional Tahsildar has certified about the relationship between the land owner and the petitioner that they are father and son, there is no need to have any confusion about the relationship. Hence, the petitioner can give a fresh representation to the respondent and on receipt of the same the respondent can consider and pass appropriate orders by taking into consideration of the certificate given by the Tahsildar within a period of four weeks from the date of receipt of representation from
the petitioner.
5. With the above observation, this Writ Petition is disposed. No costs. 09.11.2023 Index: Yes / No Speaking order / Non-speaking order bkn
