Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for entire records connected with the impugned order in O.Mu.608/2024/A5 dated 29.05.2024 passed by the respondent and quash the same as far as submitting application and obtaining Legal Heirs Certificate in online are concerned and consequently, direct the respondent to issue the petitioners' deceased brother Rajendran's Relationship Certificate manually/physically based on the petitioners representation dated 06.02.2024.

O R D E R

WMP No.22043 of 2024 filed seeking permission to file a single Writ Petition is ordered on payment of separate Court fee.

2. Mr.U.Baranidharan, learned Additional Government Pleader accepts notice for the respondent and is represented by Mr.R.Neelakandan, learned Additional Advocate General. They are armed with instructions to enable a final disposal of this Writ Petition, even at the stage of admission.

3. The petitioners challenge order dated 29.05.2024 rejecting the application filed by the siblings of one Rajendran for issuance of relationship certificate. The impugned proceedings only direct the petitioners to make an application online and the petitioners are aggrieved for the reason that the website is, according to them, not so enabled.

4. Mr.Neelakandan, states that the petitioners' application for relationship certificate with Rajendran, who is stated to be the petitioners' brother and passed away on 12.03.2023, was filed physically and not online in terms of G.O.Ms.No.110 dated 13.03.2024, which enables siblings (brothers and sisters of the deceased) to also make applications for issuance of legal heirship certificate/relationship certificate, subject to their verifying the Pg.No.2/4

particulars. According to them, the website is well enabled to receive such online application.

In light of the same, the petitioners may well file an application online as directed under the impugned order, since, in light of G.O.Ms.No.110 dated 13.03.2024 and the express assurance of the learned Additional Advocate General that the website will accept the online application, there should be no hindrance to the petitioners so applying.

As far as the petitioner's submission that the applications are still not being accepted online, as the petitioners are trying to file the same even till recently, Mr.Neelakandan, on instructions from Mr.D.Siva Chidambaram, Senior Revenue Inspector, Taluk Office, Tambaram, Chengalpattu District, who is present in Court to assist him, states that in the event of any difficulty, the petitioners may make a request to the concerned Tahsildar/sole respondent, who will definitely assist them to facilitate the process. This is recorded.

7. With this liberty and recording the assurance as above, this Writ Petition is disposed. No costs.
