Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the entire records pertaining to the rejection of petitioner's application bearing No.19914610685 (Roll No.205) for Vacancy Notification No.23020308411 published under scrutiny list in F.1/161(31)2022R.IV, dated 12.12.2024 and re-examined final scrutiny list in F.1/161(31) 2022-R.IV dated 17.04.2025 published by the fifth respondent/UPSC and quash the same as illegal and arbitrary and consequently direct the fifth respondent to consider petitioner as eligible to participate in the further selection process including the interview.

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus calling for the entire records pertaining to the rejection of petitioner's application bearing No.19914610685 (Roll No.205) for vacancy Notification No.23020308411 published under scrutiny list in F.1/161(31)20222/6
R.IV, dated 12.12.2024 and re-examined final scrutiny list in F.1/161(31) 2022-R.IV dated 17.04.2025 published by the fifth respondent/UPSC and quash the same as illegal and arbitrary and consequently direct the fifth respondent to consider the petitioner as eligible to participate in the further selection process including the interview.
2.The learned counsel appearing for the petitioner would submit that the petitioner had applied for the post of Deputy Director of Employment in the fourth respondent office based upon the Notification of UPSC in advertisement No.03/2023. The essential qualification is 'Master's degree in Economics or Statistics or Mathematics or Commerce or Psychology or Sociology or Social Work or Public Administration of Business Administration from a recognized University or Institute.'
3.It is an admitted fact that the petitioner is having a degree of MHRDM. It is the contention of the petitioner that his degree is equivalent to MBA (Human Resource Development), however, petitioner secured degree only in MHRDM. However, as per the contention of the petitioner, according to UPSC guidelines dated 3/6
05.07.2014, the degree of Master of Human Resource Development Management (MHRDM) is restructured as MBA (Human Resource Development). Even for argument sake, if his contention is accepted, for the post of Deputy Director of Employment, the required qualification is Master's degree in Economics or Statistics or Mathematics or Commerce or Psychology or Sociology or Social Work or Public Administration of Business Administration from a recognized University or Institute. The petitioner's qualification is not coming within any of the category referred to as essential qualification. 4.At this juncture, the learned counsel appearing for the petitioner would submit that the essential qualification also refers about Business Administration. Therefore, as per the above UGC guidelines, the petitioner must also to be considered for the post. 5.
It is well settled principle of law that whenever a person is applying for a post, it is his responsibility to submit equivalence certificate before the authority concerned. This Court lacks expertise to compare the qualification obtained by the petitioner and the essential qualification for the post. The learned counsel appearing for the petitioner referred the UGC guidelines.

Therefore the above guideline will in noway be useful to the petitioner to contend that he possess the required qualification. Hence I do not find any merit in the writ petition. 6.In the result, the writ petition is dismissed. No costs.
