ORDER

This writ petition has been filed seeking the issuance of a writ of mandamus directing the respondents to pay the subsistence allowance to the petitioner from 30.11.2024 and continue to pay the same till the completion of the disciplinary proceedings in Na.Ka.No.AD7/13163/2022 dated 18.04.2023 on the file of the respondent herein pursuant to the petitioner's representation dated 01.04.2026.

2. The petitioner was working as Deputy Manager (Quality Control) and was involved in paddy procurement during 2020-2021. Based on a complaint dated 04.04.2022, he was suspended on 05.01.2023 and a charge memo was issued on 18.04.2023. However, no documentary evidence has been produced to substantiate the allegations made against

him. The petitioner challenged the prolonged suspension before this Court in W.P.No.17014 of 2023 which was disposed of with a direction to consider the petitioner's representation in the light of G.O(Ms) No.81 dated 04.08.2022. Though he was due to retire on 31.05.2024, his service was extended up to 30.11.2024. However, no final order has been passed. Despite the order of this Court made in W.P.No.26244 of 2024 dated 09.09.2024 directing to complete the enquiry on or before 04.11.2025, the respondents have not complied with the said order. Therefore, the petitioner was constrained to file a writ petition in W.P.No.34614 of 2024 challenging the very issuance of the charge memo in the light of the judgment made in State of U.P Vs. Ram Prakash Singh dated 23.05.2025 and the same is still pending. The petitioner would further submit that subsistence allowance has not been paid from 30.11.2024. He has submitted several representations seeking subsistence allowance, but no action has been taken till date. Hence, the petitioner has filed this writ petition seeking the aforesaid relief.

3. In the typed set of papers, the learned counsel for the petitioner has annexed the judgments of the Hon'ble Supreme Court reported in 1999(3) SCC 679 [Capt.M.Paul Anthony Vs. Bharat Gold Mines Ltd and

Another] and Hon'ble Division Bench in W.A.No.1522 of 2011 [The Managing Director, Tamil Nadu Civil Supplies Corporation Vs The Regional Manager, Tamil Nadu Civil Supplies Corporation] in support of his case.

4. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for respondents.

5. Considering the limited scope of the prayer sought in this writ petition, and without expressing any opinion on the merits of the case, this Court directs the respondents to consider the petitioner's representation dated 01.04.2026 in the light of the above judgements cited supra and pass appropriate orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. No costs.
