PRAYER : This petition has been filed under Section 482 of Cr.P.C , to call for the records relating to the charge sheet in CC.No.1170 of 2018 (Old CC.No.14154 of 2009) on the file of Metropolitan Magistrate Court for CCB CASES AT EGMORE Quash the same.

ORDER

The petitioner herein filed this petition to call for the records relating to the charge sheet in CC.No.1170 of 2018 (Old CC.No.14154 of 2009) on the file of Metropolitan Magistrate Court for CCB CASES AT EGMORE and Quash the same.

2. When the matter is taken up for hearing the learned counsel for the petitioner submits that except this petitioner proceedings against the other accused were quashed by this Court to that effect he filed the judgment of this Court dated 03.09.2012 in Crl.O.P No. 2143 of 2010. On the other side, the learned Government Advocate (Crl. Side ) admits that proceedings against the other accused were quashed by this Court. Furthermore, the arbitration award was passed and the same was confirmed by this Court in O.P No. 382 of 2009 in O.S.A No. 314 of 2010 by the judgement dated 14.06.2011. Against which SLP preferred in SLP No. 24641 of 2011 was also dismissed. Considering the above, proceedings against the petitioner in C.C No. 1170 of 2018 (Old C.C No. 14154 of 2009) is hereby quashed.

3. In the result, this petition is allowed. No Costs. 08.01.2024
