ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents particularly the 1st Respondent to consider and pass appropriate orders on petitioner's application dated 18.12.2024 seeking to amend the Bye Laws of petitioner association so as to enable it to conduct its elections in accordance with law and further to direct the respondents to provide an appropriate timeline and necessary clarification for conduct of petitioner Association's election, after completion of the election process of the Job Federation of India, so as to ensure administration uniformity and smooth conduct of elections in accordance with law.

At the outset, the learned counsel appearing for the respondents would submit that whether the resolution for amendment of the Bye-laws has been passed with the requisite majority as contemplated under Section 2(j) of the Tamil Nadu Societies Registration Act needs to be enquired. He would submit that petitioner's application dated 18.12.2024 would be considered and

appropriate orders would be passed within a time period to be stipulated by this Court. Agreed to by the learned counsel for petitioner.

4. In view of the same and taking into consideration the facts and circumstances of the case, there shall be a direction to the respondents to consider the petitioner's application dated 18.12.2024 on its own merits and pass appropriate orders in accordance with law, after issuing notice and after affording reasonable opportunity of hearing to petitioner and any other interested persons within a period of four (4) weeks from the date of uploading of web copy without waiting for receipt of certified copy of the order. It is made clear that this Court has not expressed any views on the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
