ORDER

This petition has been filed to quash the proceedings in C.C.No.16 of 2023, pending before the learned Judicial Magistrate, Udhagamandalam.

2. The second respondent had given a complaint to the effect that on 05.09.2020 at 12.15 A.M, the petitioner who was driving a Car was intercepted and there was some argument between the petitioner and the second respondent. The petitioner is said to have abused the second respondent in filthy language and prevented him from discharging his public duty and also threatened him. Based on the complaint, an F.I.R came to be registered by the first respondent in Crime No.954 of 2020. On completion of the investigation, Final Report has been filed before the Court below and it has been taken cognizance for offences under Section 294A, 506(i) and 353 of I.P.C.

3. Heard Mr.J.Chelladurai Caldwell, learned Counsel for the petitioner and Mr.A.Damodaran, learned Additional Public Prosecutor for the first respondent.

4. The petitioner at the relevant point of time was aged about 23 years and it is stated that he was in the process of distributing free food for the needy and the poor during the pandemic period. The petitioner had also completed his law degree and is pursuing his M.B.A course in London. The entire incident had taken place in the spur of the moment and the facts of the case do not warrant the continuation of the proceedings against the petitioner.

5. In the light of the above discussion, the proceedings in C.C.No.16 of 2023 in charge sheet / final report No.FR-1099/2020 Original pending on the file of the learned Judicial Magistrate, Udhagamandalam is hereby quashed and this Criminal Original Petition stands allowed.
