Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the second respondent to consider the petitioner representation dated 21.06.2024 seeking for grant of patta in the petitioner favour for the property situated at No.27, Kempachathiram Village, Hosur Taluk, Krishnagiri District comprised in S.Nos.2, 3, 20, 22, 23 for a total extent of 12.74 acres.

ORDER
By consent of both parties, the present writ petition is taken up for final hearing at the admission stage itself.
2. The present writ petition has been filed seeking a writ of mandamus to direct the second respondent to consider the representation dated 21.06.2024, whereby, the petitioner sought grant of patta in his name in respect of the property comprised in S.Nos.2, 3, 20, 22 and 23, measuring to a total extent of 12.74 acres.

It is submitted that the subject property was originally owned by the petitioner's grandfather, namely, Patha Hanumappa Reddy @ Reddyappa, by virtue of the sale deeds dated 11.07.1885 and 04.10.1906, registered as Document No.283/1885 and Document No.941/1906 respectively. It is further submitted that the ryotiwari pattas were issued on 12.12.1928 and 07.03.1955 in respect of the subject property measuring a total extent of 12.74 acres.
4. After the demise of his grandfather, the petitioner and his Page No.2 of 6
father were in continuous possession and enjoyment of the subject property. During the lifetime of the petitioner's father, it is stated by the petitioner that he, along with his father, were engaged in agricultural activities. Even during the lifetime of his father, both the petitioner and his father have applied for grant of patta, however, the above request was not considered by the concerned respondent.

Under these circumstances, the petitioner had earlier filed a writ petition in W.P.No.24770 of 2021, praying for a direction against the respondents thereins for grant of patta in the petitioner's name in respect of the subject property. The above writ petition came to be disposed of on 19.11.2021, wherein, this Court directed the respondents therein to dispose of the petitioner's representation after conducting an enquiry within a period of twelve weeks from the date of receipt of a copy of the said order.
6. Pursuant thereto, an enquiry was conducted and the petitioner had also submitted his explanations. The fourth respondent has conducted an enquiry and a report was also made, which was forwarded to the third respondent and the third respondent proceeded to conduct an enquiry and forwarded a report Page No.3 of 6
to the second respondent vide the proceedings dated 02.08.2024. However, the second respondent has not passed any orders on the recommendation/report submitted by the respondents 3 and 4. It is under these circumstances, the present writ petition has been filed, praying for directions to the second respondent to consider the representation dated 21.06.2024.

The learned Additional Government Pleader would submit that the petitioner's representation would be considered and all relevant materials would be taken into account and appropriate orders would be passed, on its own merits and in accordance with law, within a period of eight weeks from the date of receipt of the uploaded copy of this order, after providing the opportunity of hearing to the petitioner and any other interested parties, which is also accepted to by the learned counsel for the petitioner.
8. By recording the aforesaid submissions, the present writ petition stands disposed of. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law. shall be no order as to costs.
