This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 22.04.2024, seeking bail in Crime No.272 of 2024 registered under Section 174 Cr.P.C and later, altered to the alleged offence punishable under Section 302 IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is no way connected with the alleged offence and has been suffering incarceration from 22.04.2024. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and hence, he prayed for bail.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police objection for granting bail stating that, the petitioner, who is the stepfather of the deceased/victim child, had murdered the victim child, by brutally assaulting her, in the absence of the de facto complainant. He further submitted that the incident was witnessed by the brother of the deceased child and the investigation in this case is still pending. He also submitted that if the petitioner is released on bail, there is a possibility of him absconding and threatening the witnesses. https://www.mhc.tn.gov.in/judis

Taking into consideration the statement recorded from the brother of the deceased/victim child under Section 164 Cr.P.C. and the submissions made by the learned Government Advocate (Criminal Side) that the investigation in this case is at initial stage and also considering the conduct of the petitioner and the nature and gravity of the offence committed by him, this Court is not inclined to grant bail to the petitioner.
