O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing fourth respondent to give effect and implement the order passed by third respondent vide proceedings dated 24.07.2023 whereby it was noticed on the basis of an enquiry that the extent of land in respect of Survey Nos.98/1A1 suffers from certain error and thus directed fourth respondent to rectify the same.

2. The case of the petitioner is that petitioner is the owner and in absolute possession of subject property comprised in Survey No.98/1A1

measuring an extent of 7 1⁄2 cents situated at Thirukakulam Village, Chidambaram Taluk. Petitioner derived title to subject property vide settlement deed dated 12.02.2024 and sale deed dated 01.10.2012. During sub division of the property, extent was wrongly mentioned as 7 cents in FMB sketch. Therefore, to rectify the same, petitioner submitted an application and paid necessary fees. Thereafter, third respondent, upon perusal of the revenue records and documents passed an order dated 24.07.2023, directing fourth respondent to rectify FMB sketch and transfer patta on the basis of documents and possession. However, the same was not implemented. Petitioner submitted a representation to respondents 2 & 3 and both vide order dated 18.02.2025 and 15.04.2025 directed fourth respondent to take action on the petitioner's representation and to implement order dated 24.07.2023. However, the said order has not been implemented by fourth respondent till date. Hence, the present writ petition has been filed.

3. Learned counsel appearing for petitioner submits that it would suffice, if this Court issues a direction to fourth respondent to implement the order dated 24.07.2023 passed by third respondent and pass appropriate orders, within a time frame that may be fixed by this Court.

4. Learned Additional Government Pleader appearing for respondents has no serious objection for such an order being passed by this Court.

Considering the limited request made by learned counsel for petitioner, this Court directs fourth respondent to implement the order dated 24.07.2023 passed by third respondent with regard to removal of wrong entries made in FMB sketch and pass appropriate orders, on merits and in accordance with law after issuing notice to petitioner and other interested parties, if any, within a period of four weeks from the date of uploading of web copy without waiting for receipt of certified copy. It is made clear that this Court has not expressed any view with regard to the merits of the case

and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
