This application has been filed seeking a direction to restrain the 5th respondent / Garnishee, from disbursing the amount available in the account of the 1st defendant / M/s.Ozone Projects Private Limited, to the said defendant.

2.This Court had issued a direction on 05.09.2022 that the defendants are at liberty to operate the bank account, but that the Garnishee is directed to ensure that at least a sum of Rs.50,00,000/- (Rupees Fifty Lakhs only) is retained in the account. Such order was passed on both the Garnishee / HDFC Bank and also on the 1st defendant.

3.Notices were directed. Affidavit of Service has been filed indicating that notices had been served on the 5th respondent and also on other respondents / defendants. The names and addresss of Garnishee and other respondents are printed in the cause list. There is no appearance.

5.In view of the non-appearance, this Application need not be kept still on the board of this Court and accordingly, the direction issued 05.09.2022 is confirmed and it is directed that the Garnishee / 5th respondent should retain a sum of Rs.50,00,000/- (Rupees Fifty Lakhs only) in the account of the 1st defendant / M/s. Ozone Projects Private Limited, till the disposal of the suit in Account No : 05230350005481. If any variations is required of this order, the parties can apply for the same by filing necessary application. This application is disposed of accordingly. 16.11.2022 (1/2) smv
