ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 22.09.2021 for the alleged offences punishable under Section 6 r/w.5(1) of POCSO Act and Section 9, 10 of Prohibition of Child Marriage Act 2006 in Crime No.11 of 2021 in Crime No.8 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the defacto complainant is the minor victim girl and she was under the care of her grandmother/petitioner. The petitioner and her son/father of the victim girl arranged marriage of the victim to their relative A1. After the marriage, A1 had sexually assaulted her. Hence, the complaint.

3.The learned counsel appearing for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution and she has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) submits that the statement of the victim girl u/s 164 Cr.P.C was recorded. https://hcservices.ecourts.gov.in/hcservices/

5.On perusal of the statement recorded under Section under 164 of Cr.P.C, reveals that the petitioner demanded a sum of Rs.1,00,000/- from A1 for performing marriage. Again and again, the petitioner demanded further sum of Rs.20,000/- and Rs.10,000/- from A1, for which, there was a quarrel between A1 and the petitioner. It further reveals that the victim girl didn't want to stay along with her grandmother.

6. Considering the submissions made by both counsel and on perusal of 164 Statement reveals that there was a serious allegations levelled against the petitioner, this court is not inclined to grant bail to the petitioner.
