The Writ Petition had actually been disposed of on 02.01.2023. The order was dictated in open Court. On conclusion this Court had directed that costs follow and had accordingly directed that the petitioner and the 7th respondent should pay costs of Rs.50,000/- each to the Tamil Nadu State Legal Services Authority, Chennai. Even though that particular statement was made by me in the open Court, it was requested even then that this Court may not impose costs. However, the costs as stated was retained in the order. 3.

Subsequently, the matter has now been listed under the caption 'for Being Mentioned'. It is uniformly stated by both the learned counsel for the petitioner and for the 7th respondent that the issue of costs alone may be re-examined and re-visited by this Court. https://www.mhc.tn.gov.in/judis

Taking a broader view and hoping that the petitioner and the 7th respondent would at some time in the future would join hands to ensure that the wishes of the testator of the Will under which they both seek profit is honoured by both of them, the order is interfered with only to the limited extent of withdrawing the direction for payment of the costs.
