Respondent Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of certiorarified mandamus to call for the records pertaining to the rejection letter passed by the respondent dated 17.11.2022 Ref: KIL/CHOME/22/FAD/1 and quash the same as illegal and consequently directing the respondent to return the deposited e-auction advance amount of Rs.6,01,000/- to the petitioner.

ORDER

(Order of the court was made by the Hon'ble Chief Justice) Learned counsel for the petitioner, on instructions, seeks leave to withdraw the writ petition. Learned counsel submits that the petitioner would approach the Debts Recovery Tribunal.

2. The writ petition is dismissed as withdrawn. In case the petitioner has remedy, the petitioner may avail the same. There will be no order as to costs. Consequently, W.M.P.No.23163 of 2023 is closed.
