W.M.P.No.23268 of 2020 in W.P.No.24161 of 2018 R.SUBBIAH, J and C.SARAVANAN, J (The Order of the Court was made by R.Subbiah, J) This petition has been filed to direct the three affiliated private medical colleges in Puducherry to issue to the MBBS students who have paid annual fee at Rs.12.50 lakhs per year till now, the No Due Certificates, Hall Tickets, Attendance and all other reports which are necessary to be submitted for writing their future regular and supplementary theory and clinical semester examinations, practicals and all other tests without demanding payments of any additional amounts towards their annual fees, pending disposal of the Writ Petition in W.P.No.24161 of 2018.

2. It is brought to the notice of this Court that in similar circumstances, this Court, in W.M.P.No.29667 of 2018 in W.P.No.23732 of 2017, by order dated 27.09.2018, had granted the following relief: "Mr.A.Gandhiraj, learned Government Pleader (Pondy), takes notice for Respondents 1

and 2. Mr.T.V.Lakshmanan, learned counsel takes notice for Respondentes 23 and 4 and Mr.A.Jenasenan, learned counsel takes notice for the 5th respondent.

2. There shall be an order of interim direction as prayed for by the Petitioner. It is made clear that this order is passed subject to the result of the Writ Petition. It is also made clear that the petitioner cannot claim equity, if the Writ Petition is decided against him.

3. This Miscellaneous Petition is ordered accordingly."

Upon hearing the learned counsel appearing for the parties and following the above said order of this Court, there shall be an order of interim direction as prayed for by the petitioner, in this W.M.P. also. It is made clear that this order is passed subject to the result of the present Writ Petiton. It is also made clear that the petitioner-Association cannot claim equity, if the Writ Petition is decided against them.

4. This W.M.P. is ordered accordingly.
