ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(i) of TNP Act r/w 4(1)(A) of TNP (Amendment) Act, 2024 in Crime No.57 of 2025, seeks anticipatory bail.

2. The case of the prosecution is that on 07.06.2025 at 8.45 a.m., the respondent police, after receiving a secret information, went to Kuppanatham Village where they found the petitioner unlawfully selling a Express Brancy 9 bottles contains 180 ml and Express Brandy 1 bottle contains 90 ml, totally 10 bottles and suddenly, the petitioner escaped from the scene of occurrence and the respondent police seized the above said bottles.

3. Learned counsel for the petitioner submitted that the petitioner is no way connected with the offence as alleged and she has been falsely implicated in this case. He further submitted that the petitioner is willing to abide by any stringent conditions that may be imposed by this Court. Therefore, he prays for grant of anticipatory bail to the petitioner. Learned Government Advocate (Crl.Side) appearing for the respondent police strongly opposed for grant of anticipatory bail to the petitioner stating that the petitioner has one previous case similar in nature against her and if she is enlarged on bail, the petitioner may abscond and may commit similar offence and tamper the witnesses.

5. Considering the fact that the petitioner has one previous case similar in nature against her, this Court is not inclined to grant anticipatory bail to the petitioner.
