ORDER

This writ petition has been filed for issue of writ of mandamus directing the 4th respondent to act upon the application submitted by the petitioner on 24.02.2025, wherein, the petitioner has sought for electricity service connection

3/7 for the house situated at S.No.112/1 Vanamadevi Village and Post, Kattumannarkoil Taluk, Cuddalore District.

2.The learned counsel for the petitioner submitted that the respondents were insisting for getting No Objection Certificate from the revenue authorities and hence, the petitioner had applied for patta before the concerned Tahsildar. Since the same was not considered, the petitioner filed W.P.No.21540 of 2023 for a direction to the Tahsildar to issue patta. This writ petition was disposed by an order dated 21.07.2023. Pursuant to the said order, the specific case of the petitioner is that patta has been issued in favour of the petitioner. The petitioner has informed the TANGEDCO regarding the issuance of patta in his name and in spite of the same, the application submitted by the petitioner for electricity service connection was kept pending and it is under these circumstance, the present writ petition came to be filed before this Court. 3.The learned Standing Counsel appearing on behalf of the respondents submitted that the 4th respondent was not able to act upon the application

4/7 submitted by the petitioner in view of the proceedings of the District Collector dated 22.09.2023, whereby, the District Collector had directed for the construction of a Government Higher Secondary School in the property. 4.In the considered view of this Court, the application submitted by the petitioner is now pending before the 4th respondent. The 4th respondent has to either act upon the same and give electricity service connection to the petitioner. If the 4th respondent is not inclined to consider the application, the petitioner must be informed regarding the same, so that the petitioner can workout his remedy. The application cannot be kept in limbo. 5.In the light of the above discussion, there shall be a direction to the 4th respondent to act upon the application submitted by the petitioner for electricity service connection or on the alternative, if the 4th respondent is not inclined, inform the petitioner in writting as to why electricity service connection cannot be given to the petitioner. In either case, the same shall be conveyed to the

5/7 petitioner, within a period of four weeks from the date of receipt of copy of this order.
