Respondents Writ Petition is filed under Article 226 of the Constitution of India to issue a writ of mandamus seeking direction to the respondents herein to consider my representation dated 07.05.2019 and consequently direct the respondents to 1/5

ORDER

The present writ petition has been filed seeking a direction against the respondents herein to consider my representation dated 07.05.2019 and consequently direct the respondents to promote me as Special Sub-Inspector of Police 2.Heard Mr.Prakasam J, learned counsel for the petitioner, and Mr.A.M.Ayyadurai, learned Government Advocate for the respondents. The court also perused the materials placed on record. 3.The learned counsel for the petitioner submitted that the petitioner joined the service on 25.05.1988 as a Grade II Police Constable. He was subsequently promoted to Grade I Constable on 25.10.1999 and then to Head Constable on 28.10.2004. As per G.O.Ms.No.844, Home (Police-V) Department dated 03.06.1997, and G.O.Ms.No.15, Home (Police-V) Department dated 07.01.2010, any person who has served as a Grade II Police Constable for 10 years is eligible 2/5

for upgradation to Grade I Police Constable. After serving 5 years in Grade I, the person becomes eligible for upgradation to Head Constable. Further, after completing 10 years as a Head Constable, the individual becomes eligible for consideration for upgradation to the post of Special Sub-Inspector (SSI) of Police.

3.1.The petitioner has completed 25 years of service, including over 10 years as a Head Constable. However, he has not been granted regular promotion to the post of Sub-Inspector of Police. It is also submitted that there are no pending disciplinary proceedings against the petitioner. Despite having completed the required service, he was not promoted to Sub-Inspector of Police upon completing 10 years as Head Constable. In this regard, the petitioner had submitted a representation to the respondents on 07.05.2019, requesting consideration for upgradation and promotion to the post of SSI. However, no action has been taken on his representation to date. 4.In view of the facts and circumstances of the case, the respondents are directed to consider the petitioner's representation dated 07-05-2019 and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

5.With the above direction, the writ petition is disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition, if any, is also closed.
