Crl.M.P.No.10714 of 2023 in Crl.O.P.No.10309 of 2023 S.SOUNTHAR This petition has been filed seeking to modify the condition imposed in Crl.O.P.No.10309 of 2023 by order dated 05.05.2023 directing the petitioner to deposit title deed of immovable property either in his name or in the name of his blood relatives for the value of Rs.5,00,000/- as a condition for anticipatory bail.

2. The learned counsel appearing for the petitioner submits that after order passed by this Court in anticipatory bail application, the petitioner and the defacto complainant entered into a settlement whereunder the entire amount of Rs.5,00,000/- was paid by the petitioner to the defacto complainant by way of three installments on 18.08.2023, 24.08.2023, 12.10.2023. The learned counsel also filed an affidavit to that effect and the defacto complainant also filed an affidavit dated 12.12.2023 stating that he had received a sum of Rs.5,00,000/- from the petitioner.

3. The learned counsel for the respondent herein filed a status report of respondent police dated 12.12.2023, wherein, it is stated by him that 1/3

the defacto complainant filed a written statement before the Police that he received Rs.5,00,000/- from petitioner on 12.10.2023.

4. In view of the affidavits filed by the petitioner, the defacto complainant and also the status report filed by the respondent police, this Court is inclined to allow this application by deleting the condition No.(c) in the order passed by this Court in Crl.O.P.No.10309 of 2023, dated 05.05.2023. The petitioner is granted two weeks time to comply with the other conditions.
