Respondent ***** Both the counsels, on instructions, have made an endorsement in the Court bundle that the parties to the dispute are agreeable for appointment of an Arbitrator by this Court. They have also made an endorsement that this application can be disposed of, granting liberty to the applicants to file a similar application before the Arbitrator under Section 17 of the Arbitration and Conciliation Act.
2.By consent of parties, this Court appoints a)Mr.Sanjay Pinto, Advocate, having Office address at No.5, 'Manasarovar', 1st Floor, 60, C.P.Ramaswamy Road, Alwarpet, Chennai600 018, Mobile No.98400 91547 as the Sole Arbitrator to adjudicate the 1/4
dispute between the applicants and the respondent arising out of the agreement dated 28.06.2022;
b) The Sole Arbitrator shall be paid his remuneration / fees in accordance with the 4th schedule of the Arbitration and Conciliation Act, 1996;
c) Both the parties shall share equally the fees payable to the Sole Arbitrator;
d) The Sole Arbitrator shall adhere to the provisions of the Arbitration and Conciliation Act, 1996 while passing the arbitral award; e) The Sole Arbitrator shall complete the arbitration within the stipulated time as prescribed under the Arbitration and Conciliation Act, 1996.
3.Accordingly, this application is disposed of and the applicants are granted liberty to file a similar application before the Arbitrator under 2/4
Section 17 of the Arbitration and Conciliation Act, 1996, seeking for a similar relief and the respondent is also permitted to raise objections as and when such an application is filed and the Arbitrator shall decide the said application, on merits and in accordance with law. 15.09.2023 ab 3/4
