This petition has been filed to modify the condition that the petitioner shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) as non refundable deposit to the credit of the District Revenue Officer, Salem, which is imposed in Crl.O.P.No.6388 of 2023 dated 11.04.2023.
2. The learned counsel for the petitioner submitted that this Court, by an order dated 11.04.2023, had granted bail to the petitioner in Crl.O.P.No.6388 of 2023 with a condition to deposit a sum of Rs.1,00,000/- (Rupees one lakh only) to the credit of the District Revenue Officer, Salem. He further submitted that despite the best efforts, he was unable to raise the huge amount. Thereby, he seeks for modification of the condition.
3. Heard both sides.
4.Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel on either side, this Court is inclined to modify the Condition (Paragraph 7), which shall be read as follows:- " 7. Accordingly, the petitioner shall deposit a sum of Rs.90,000/- (Rupees Ninety Thousand only) as non-refundable deposit to the credit of the District Revenue Officer, Salem and on such deposit, the petitioner is ordered to be released on bail Page No.1/3
in the event of arrest or on his appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Judicial Magistrate No.II, Salem, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed and on further condition that:"
The other conditions imposed by this Court in Crl.O.P.No.6388 of 2023 on 11.04.2023 shall remain unaltered. Further period of two weeks time is granted to the petitioner to surrender and execute sureties before the concerned Magistrate as imposed by this Court, from the date on which the order copy made ready. Failing which, the petition for anticipatory bail shall stand automatically dismissed and no further extension will be granted.
5. In view of the above, this Criminal Miscellaneous Petition is ordered.
