Respondents Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus directing the respondents to proceed ahead with evicting the illegal occupier, Mr.Mariaselvamani, and handover the said place of 0.71 cents to the Nandanagar Resident Welfare Registered Society, so that proper Public Park can be brought up in the said place.

ORDER

(Order of the Court was made by the Hon'ble Acting Chief Justice) On the last date, namely 30.9.2019, the following order was passed:

"None present for the petitioner even in the second calling. The matter is shown as item No.1 in the cause list. Pre-lunch session, when the matter was called, nobody appeared for the petitioner, though name of the counsel viz., M/s.SB and Partners, has been shown in the cause list. The matter was again taken up post-lunch session at 2.30 P.M. Again nobody appeared for the petitioner. Therefore, it is inferred that the petitioner or his counsel is not interested in the present writ petition. However, in the interest of justice, the matter is directed to be listed under the caption 'for dismissal' on 03.10.2019."
