PRAKASH CRIMINAL MISCELLANEOUS PETITION No.10005 of 2019 IN CRL.A.No.459 OF 2019 A.VIJAY @ VIJAYAKUMAR [ ACCUSED/APPELLANT ] Vs STATE REP.BY [COMPLAINANT/ RESPONDENT ] THE INSPECTOR OF POLICE, ALL WOMEN POLICE STATION, PERAMBALUR DISTRICT.

Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL.A.No.459 OF 2019 on the file of the High Court, the High Court will be pleased to suspend the sentence under section 417 of IPC imposed 1year R.I. and fine Rs.2000/- in default 3 months S.I. and under Section 376 of IPC imposed 12 years R.I. and fine Rs.5000/- in default 5 months S.I. Concurrently by the sessions judge, Mahila Court, Perambalur in SC No.39 of 2018 dated 30.05.2019 and to enlarge the appellant on bail pending disposed of this above Crl.A.No.459 of 2019.

Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in CRL.A.No.459 OF 2019 on the file of the High Court and upon hearing the arguments of M/S.S.RAVICHANDRAN, Advocate for the petitioner and of MR. KRITIKA KAMAL.P, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- Today, when the criminal miscellaneous petition was taken up for hearing, the learned counsel for the petitioner has sought permission of this Court to withdraw the petition. He has also made an endorsement to that effect.

In view of the submission and the endorsement made in the petition, the criminal miscellaneous petition is dismissed as withdrawn.
