ORDER

The petitioner, who was arrested and remanded to judicial custody on 19.05.2026 for the alleged offences under Sections 4(1)(A) of Tamil Nadu Prohibition Act, 2024 in Cr. No.217 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the accused were found with possession of 58 nos. of 180 ml spurious liquor bottles and hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has nothing to do with the commission of offences as alleged by the prosecution. The learned counsel would further submit that the petitioner has been remanded to judicial custody on 19.05.2026 and hence prayed to enlarge the petitioner on bail.

4. The learned Government Advocate (Criminal side) appearing for the respondent police would submit that the petitioner has 108 previous cases of similar nature and therefore, he objected the bail application.

5. As against this petitioner, there are about 108 previous cases of similar nature and therefore, this is a case of recidivism. As rightly contended by the learned Government Advocate, if any bail is granted to the petitioner, the number 108, will have one more addition in his crime record. Hence considering the past conduct of the petitioner, this Court is not inclined to enlarge the petitioner on bail.

6. Accordingly, this Criminal Original Petition is dismissed. 12-06-2026 MJS Note:
