ORDER

This Criminal Original Petition has been filed seeking a direction to the Principal District and Sessions Judge, Ariyalur (Special court for SC/ST cases), Ariyalur, to consider the petitioners' bail application sympathetically and pass orders on merits on the same day of their surrender, in connection with Cr.No.62 of 2026, pending on the file of the respondent police.

2. Heard the learned counsel for the petitioners, and the learned Government Advocate (Crl. Side) for the respondents 1 and 2.

3. The learned Government Advocate (Crl. Side) submitted that the de facto complainant, along with five other women, had gone to collect cashew nuts in a private grove. At that time, the first petitioner, who had taken on lease a Government owned cashew grove, allegedly misunderstood that they were collecting cashew nuts from the leased land and abused them using prohibitory words and assaulted them. It is further alleged that the other petitioners joined the first petitioner, abused the de facto complainant and the other women by referring to their caste names and also threatened them. He further submitted that the de facto complainant initially lodged a complaint before the jurisdictional Police. However, the same was not taken on file. Thereafter, the de facto complainant approached the learned Special Judge by way of a private

complaint. The learned Special Judge forwarded the complaint to the Police for appropriate action. Pursuant thereto, the Police conduced an enquiry into the allegations and upon being satisfied with regarding the prima facie veracity of the complaint, registered the present case.

4. The learned counsel for the petitioners submitted that the petitioners have been falsely implicated in the present case.

In view of the above factual position, there shall be a direction to the Principal District and Sessions Judge, Ariyalur (Special court for SC/ST cases), Ariyalur to consider the petitioners' bail application, preferably on the same day of their surrender, in connection with Crime No.62 of 2026 on the file of the respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioners shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
