Respondent PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C., praying to modify the condition imposed by the Principal Sessions Judge, Chennai in Crl.M.P.No.8328 of 2018 dated 07.06.2018 that one must be a blood surety, may be modify as ordinary surety and reduce the surety amount for a sum of Rs.10,000/- to Rs.5,000/- to execute the bond for his release. O R D E R

The petitioner was arrested on 05.05.2018 and he was granted bail in Crl.M.P.No.8328 of 2018 on 07.06.2018 by the Sessions Court, Chennai, on certain conditions, one of which is that, "[ii] Petitioner is ordered to be released on bail on his executing a bond for Rs.10,000/- with two sureties, one must be a blood surety, each for a likesum to the satisfaction of IX Metropolitan Magistrate, Chennai." Seeking modification of the said condition, this petition has been filed. 2.It is the case of the petitioner that his father had died and his mother is sick and there is one younger sister and therefore, he has not been able to furnish blood surety. In cases of this nature, such conditions cannot be said to be irregular, because experience shows that the accused abscond after furnishing bogus sureties. However, since the accused has not been able to enjoy the fruits of the bail order from 07.06.2018, the condition relating to "blood surety" is modified to "relative surety". Rest of the conditions shall remain the same.
