This Court is satisfied with the reasons stated in the affidavit filed in support of this petition, which has been filed seeking to condone the delay of 31 days in filing the petition seeking to restore the appeal, which was dismissed for non-prosecution as against the first respondent.

Accordingly, this petition is allowed as prayed for.

Registry is directed to number the petition, filed to restore the appeal, which was dismissed for nonprosecution as against the first respondent if the same is otherwise in order and list the appeal on 02.09.2024.
