ORDER

This petition has been filed seeking return of deposit of Rs.8 Lakhs lying to the credit of Crime NO.18 of 2022 which has been deposited before the Judicial Magistrate No.VI, Salem, on 28.06.2023 in pursuant to the order passed by this Court in Crl.M.P.No.4537 of 2023.

2. The petitioner name has now been deleted from the Crime No.18 of 2022. The record of deletion report has been filed by the respondent on 04.03.2025, stating that the petitioner is no more accused in the case in Crime No.18 of 2022 and also in the charge sheet filed by the respondent.

3. Hence, after coming to know about the deletion report filed before the Lower Court, this petition was filed on 13.02.2025 seeking for return of deposit of Rs.8 Lakhs, and the same was returned on the same day with an endorsement "the condition of the deposit order passed by this Court, hence, the return of deposit by this petition cannot be entertained by this Court" Hence, the present petition, pursuant to the denial of return of the petition and deposited amount.

4. Learned Government Advocate, produced a copy of the deletion report by confirming that the petitioner is not an accused in the case in Crime No.18 of 2022 registered on 28.02.2022. On completion of investigation, the charge sheet was made and held but the final report filed on 28.04.2024. The petitioner is A2.

The petitioner's wife is A1. Now, the petitioner had been deleted from the case. Hence, the petitioner is no more accused in this case. Therefore, he has no objection to return the deposited amount to the petitioner.

5. It is seen that the petitioner had deposited a sum of Rs.8 Lakhs at the time of granting anticipatory bail to the petitioner in Crl.O.P.No.4537 of 2023. Now, the petitioner has been discharged from the case.

6. In view of the above, the learned Judicial Magistrate No.VI, Salem, is directed to return the amount of Rs.8 Lakhs deposited by the petitioner by receipt No.432196 dated 02.09.2023, along with accrued interest, if any.

7. Accordingly, this Criminal Miscellanous Petition is disposed of. Registry is directed to return the original petition, which has been filed before the Lower Court, to the petitioner.
