ORDER
The petitioners apprehend arrest for the alleged offence punishable under Sections 4(1)(A), 4(1)(c) of the Tamilnadu Prohibition (Amendment) Act, 2024
in Crime No.47 of 2026 on the file of the respondent police, seek anticipatory bail.
2. The allegation against the petitioners is that the petitioners were found in illegal possession of 266 alcohol bottles. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioners are innocent and they have been falsely implication in this case. He further submitted that they are ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that the petitioners are husband and wife and that they are having 46 previous cases pending against them. Hence, he opposed to grant anticipatory bail to the petitioners.
5. Considering the gravity of the offences and the fact that the petitioners are husband and wife, and are having 46 previous cases pending against them, this Court is not inclined to enlarge the petitioners on anticipatory bail.
