The present Writ Petition has been filed for the issuance of a Writ of Mandamus to direct the first respondent to consider the representation sent on 21.09.2020 against the second respondent which is pending before the Revenue Divisional Officer (RDO)-cumExecutive Magistrate at Chennai and pass order in accordance with law within a stipulated time that may be fixed by this Court.
2. The learned counsel for the petitioner submits that the petitioner has given a complaint under Section 23 of the Maintenance and Welfare of Parents and Senior Citizen Act, 2007, before the first respondent, but, the same is yet to be disposed of by the first respondent. Hence, the petitioner is before this Court.
3. Heard the learned counsel appearing for the petitioner and learned Special Government Pleader appearing for the first respondent.
4. Considering the facts and circumstances of the case and the submissions made on either side, this Court, without expressing any opinion on the merits of the representation, directs the first
respondent/the Revenue Divisional Officer - North, Tondiarpet, to consider the petitioner's representation dated 21.09.2020 and pass appropriate orders, on merits and in accordance with law, after issuing notice to the petitioner and the persons interested in this regard and also affording them an opportunity of personal hearing, within a period of four (4) weeks from the date of receipt of a copy of this order. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
