The petitioner, who was arrested and remanded to judicial custody on 03.07.2022 for the offences punishable under Section 174(iv)(Suspicious Death) Cr.P.C. @ Section 302 of IPC in Crime No.165 of 2022 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that, there was a civil dispute between the petitioner and the deceased, who is none other than the step mother of the petitioner herein. On 02.07.2022 at about 2.30 p.m., the deceased was found dead in her room in a suspicious manner with her knee bone broken. Hence, the complaint.
3. The case was initially registered under Section 174 of Cr.P.C. and thereafter, altered into Section 302 of IPC. The deceased is the step-mother of both the de-facto complainant and the petitioner. She is aged about 80 years. Due to property dispute, the petitioner attacked his own step-mother with wooden log, as such she sustained grievous injuries and died.
4. Therefore, the petitioner has committed a very serious and heinous offence as against his own step-mother and this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition is dismissed.
