The petitioner apprehends arrest for the alleged offence under Sections 296(b), 118(1), 115(2) and 351(3) of BNS Act, in Crime No.Not Known of 2026 on the file of the respondent police seeks anticipatory bail.
2. The case of the prosecution is that, due to previous enmity, the petitioner abused the de facto complainant in filthy language and assaulted him with wooden logs, causing injuries. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that he is an innocent person and has been falsely implicated in this case. She would submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, she prays to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police opposed the grant of anticipatory bail on the ground that there are three previous cases pending against the petitioner. 2/4
5. Taking into consideration of the totality of the circumstances and the fact that the petitioner has previous criminal antecedents, this Court is not inclined to enlarge the petitioner on anticipatory bail.
