Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the second respondent the District Revenue Officer, Cuddalore to cancel the UDR Patta granted to R.Mullainathan S/o.Rasu Pillai of Kothattai Village for the S.F.No.184/5A measuring 0.01 Hectare of Kothattai Village and issue the patta to the petitioner M.Pazhamalai, S/o.Muthu of Kothattai Village, Tittagudi Taluk as requested by the petitioner in the representation dated 04.03.2015, 16.03.2020 and 22.09.2020 within a stipulated time as specified by this Court. The petitioner herein seeks a direction to the second respondent to consider his representation for cancellation of UDR patta granted in the name of the fifth respondent within a time stipulated by this Court. 2/5

According to the petitioner, the land situated in S.No.184/5A at Kothattai Village, Tittagudi Taluk, Cuddalore District, covered by patta No.258 with an extent of 50 acres, originally belongs to his father and patta also issued in the name of his father. Later regarding the portion of the above said property, patta was issued in the name of the fifth respondent in Patta No.264 by giving new sub-division S.No.184/5A. The petitioner made several representations to the respondents seeking cancellation of patta issued in the name of fifth respondent and the last representation of the petitioner dated 25.08.2023. The same has not been considered till date and hence, the petitioner is before this Court.

3. Mr. A.Selvendran, learned Special Government Pleader takes notice for the respondents 1 to 4 would submit that the representation of the petitioner will be considered on merits and in accordance with law.

In view of the limited prayer made by the petitioner, this Court is inclined to issue a direction to the second respondent to consider the representation of the petitioner on 25.08.2023 and pass final orders on merits, within a period of six weeks from the date of receipt of copy of this order, after issuing notice to the fifth respondent.

5. With the above direction, this Writ Petition is disposed of. No costs.
