Respondents Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the order dated 15.06.2019 in Pa.Mu.A2/2656/2019 on the file of the Second Respondent, and quash the same and consequently direct the Second Respondent to hold fresh enquiry after furnishing copies of petition and documents filed by Fifth Respondent and affording adequate opportunity of personal hearing to all parties concerned to produce supporting documents and to make oral & written submissions, and pass orders afresh on the petition filed by Fifth Respondent, in accordance with law.

Mr. R. Venkatesh, Learned Government Advocate takes notice for the First to Fourth Respondents.

When it is pointed out by the Learned Government Pleader appearing for the First to Fourth Respondents that the Petitioner has got an effective alternative remedy under Section 13 of the Tamil Nadu Patta Pass Book Act, 1983, to challenge the order impugned in the Writ Petition, Learned Counsel for the Petitioners seeks permission of this Court to withdraw the Writ Petition with liberty to resort to the same and he has made an endorsement to that effect, which is recorded. 3.

Accordingly, the Writ Petition is dismissed as withdrawn granting such liberty. It is needless to add here that if such revision is preferred, the Revisional Authority after affording full opportunity of hearing to the parties concerned in consonance with the principles of natural justice shall consider all the contentions that are raised in such revision and pass a reasoned order on merits and in accordance with law and communicate the decision taken. Consequently, connected Miscellaneous Petition is closed. No costs.
