By these applications, the defendants seek to re-open the defendants' evidence and recall D.W.2, Mr.Manivannan Rajan. By order dated 20.06.2024, the proof affidavit of D.W.2 was eschewed and the evidence on behalf of the defendants was closed. Learned counsel for the defendants submits that D.W.2 is the Surveyor. Since the annexures to the Surveyor's report had not been filed originally, he submits that an application for permission to receive the said annexures was filed. Consequently, he submits that evidence could not be recorded in accordance with the schedule fixed by this Court earlier.

2. Learned counsel for the plaintiff has no serious objection for these applications to be allowed. Upon examining the affidavit in support of these applications and being satisfied that sufficient cause is shown, these applications are allowed as prayed for.
