Respondents Petition filed under Article 226 of the Constitution of India, for issuance of a writ of Mandamus directing the respondents to consider the petitioner's representations dated 31.05.2016 and 04.07.2016 and direct the respondents to fill up the post of Superintending Engineer and to appoint the petitioner in the vacant post in accordance with the panel dated 06.01.2016.

ORDER
This writ petition has been filed to direct the respondents to consider the petitioner's representations dated 31.05.2016 and 04.07.2016 and to fill up the post of Superintending Engineer and to appoint the petitioner in the vacant post in accordance with the panel dated 06.01.2016.
2.The petitioner is due to retire on 31.07.2016. According to the seniority list, he stands in Sl.No.9 for promotion to the post of Superintending Engineer. According to him, there are already 10 posts vacant which have not been filled up for the last three months. Therefore, the learned counsel for the petitioner prays that the petitioner may be considered for promotion at least before his retirement so that he would retire as Superintending Engineer and get some emoluments. counsel for the petitioner has also submitted that the petitioner has made representations dated 31.05.2016 and 04.07.2016 and the same may be directed to be considered by the respondents.
3.The learned Special Government Pleader submits that promotion has to be made for many persons, and the same will be considered only in accordance with the seniority. 4.Taking note of the above submission made by the learned Special Government Pleader and also taking into consideration of the fact that the petitioner is due for retirement on 31.07.2016, the respondents are directed to consider the representation of the petitioner dated 31.07.2015 and pass appropriate orders, before the retirement date of the petitioner, ie. 31.07.2016.
5.With the above direction, the writ petition is disposed of. No costs.
