ORDER
This writ petition has been filed challenging the on-line refusal order of the 3rd respondent dated 14.02.2025 and for a direction to the 3rd respondent to issue legal heir ship certificate by entering the name of the petitioner as the class II legal heirs of the
deceased R.Santhamani.

When the writ petition was taken up for hearing, the learned Additional Advocate General appearing on behalf of the respondents produced the written instructions given by the 3rd respondent. On going through the written instructions, it is seen that the legal heir ship certificate was rejected on the ground that the petitioner did not submit the necessary documents. 3.
On going through the materials placed before this Court, it is seen that already an enquiry was conducted by the Tahsildar and the Tahsildar has ascertained the fact that the husband of the deceased viz., Ramasamy had separated from Santhamani and he died on 27.12.2011. It was also ascertained that the said Santhamani died on 07.07.2022 leaving behind the petitioners, who are the sisters of the deceased. The reason that has been assigned in the on-line rejection order is that the petitioners are only the class II legal heirs and therefore, the legal heir ship certificate cannot be given. 4.
In the considered view of this Court, even a class II legal heir is entitled to be added in the legal heir ship certificate as per the
latest GO No.110 dated 13.03.2024. Therefore, there shall be a direction to the 3rd respondent to issue legal heir ship certificate by incorporating the name of the petitioners, who are the class II legal heirs of the deceased Santhamani, within a period of four weeks from the date of receipt of a copy of this order.

In the result, this writ petition is allowed with the above directions. No costs. Consequently, the connected miscellaneous petition is closed.
